Centerton Planning Commission Recap: November 18, 2025

The November 18 Planning Commission meeting was focused and fast, but the single agenda item held big implications for homeowners, especially with statewide changes coming in January.


Quick Start: Roll Call and Minutes

The commission opened with roll call and approved the minutes from the November 4 meeting without any opposition.


Admin Approvals

One home occupation approval was ratified for concrete coating services at 110 Ambry Loop.


Main Item: Hagerman Pool House ADU (CU25-19)

The only new business was a public hearing for a conditional use request at 1500 Providence Court, Lot 77 of the Versailles subdivision.

What the Homeowners Are Building

Brad Hall with CMI Construction represented owners Josh and Melissa Hagerman. Their plan includes:

• A pool behind the existing home
• A pool house between the home and pool
• A kitchenette, indoor lounge, bathroom
• Outdoor kitchen and covered patio
• Conditioned storage and a garage for lawn and pool equipment
• 1,232 square feet total footprint
• 880 square feet of livable ADU space

The design doesn’t include an official bedroom, but since the conditioned storage could function as one, it qualifies as an ADU.

Zoning and Staff Notes

The property is zoned R1 low-density single-family, which currently requires conditional approval for any accessory dwelling unit. Staff confirmed the homeowners met all notice requirements, and no public comments were submitted.

Why This Matters: Act 313 Takes Effect in January

A key point in the meeting was the reminder that Arkansas Act 313, passed earlier this year, will take effect January 1, 2026.
Act 313 restricts how cities can regulate accessory dwelling units. Once it goes live, homeowners will have far more freedom to build ADUs without navigating the current conditional-use process.

Because the Hagermans want to begin construction before January, their project had to follow the existing rules and come before the Planning Commission. After Act 313 takes effect, similar ADUs will move through a simpler path, which will likely increase interest across Centerton.

This shift matters for homeowners, future sellers, and anyone watching long-term neighborhood trends.

Utilities

• The ADU will share water service with the main home.
• A septic modification was approved by the Arkansas Department of Health, adding a new 150-gallon tank and two new lines.

POA Review

Although the city does not enforce subdivision covenants, the homeowners secured the required POA and architectural review approval from Versailles.

Commissioner Questions

Commissioners asked for clarity on:
• Whether the conditioned storage could function as a bedroom
• Septic capacity
• Setbacks
• Fence adjustments around the new structure

All questions were answered without concern.

Public Hearing

Opened and closed with no comments.

Final Vote

The commission voted unanimously to approve the conditional use permit. The approval remains valid unless the use changes.


Announcements

• Two Planning Commission meetings are scheduled for December 2.
• The Tech Review meeting on November 20 will likely be cancelled.
